Offering online money games can lead to up to three years in prison and a fine of up to ₹1 crore. Advertising them can lead to up to two years and a fine of up to ₹50 lakh. Repeat offences carry heavier penalties.

What does the law mean if you bet online?

  • Banks and UPI apps are barred from processing payments to online money games, so deposits and withdrawals can be blocked or frozen.
  • If a site refuses to pay you, an Indian court or consumer forum is unlikely to help you recover the money.
  • An offshore licence from Curaçao, Malta or anywhere else doesn't make a site legal in India.
  • Winnings are still taxable income, and foreign exchange rules restrict sending money abroad for betting.

  1. 1867

    Public Gambling Act

    A colonial-era law that bans running or visiting a common gaming house. It predates the internet and says nothing about online play.

  2. 1950

    Gambling becomes a state subject

    The Constitution lists betting and gambling under Entry 34 of the State List, so each state writes its own gambling laws.

  3. 2000

    Information Technology Act

    Gives the central government powers over online services, including blocking websites. Later rules used it to oversee online gaming.

    New taxes on online gaming

    Net winnings from online games are taxed at 30%, and operators pay 28% GST on the full value of deposits.
